Discharge of obligation under Schedule 5, section 1, (1.1) (Affordable Housing Review) of the S106 Agreement by Deed dated 16th March 2016 pursuant to Planning Permission ref: 15/03035/FUL (Demolition of the existing building and erection of a 4 storey residential building comprising of 14 flats (4 No. 1 bedroom flats, 8 No. 2 bedroom flats and 2 No. 3 bedroom flats) with associated communal amenity space, cycle parking and refuse storage.) granted on 08.03.2016. Schedule 5, section 1, (1.1) states: i) To remove the requirement for a review mechanism as set out at Schedule 5, section 1, (1.1) On Disposal of 11 of the residential units approved in the Permission to:- (a) undertake and complete an Affordable Housing Review at its own cost and serve a copy on the Council; and (b) pay to the Council on demand the proper and reasonable costs incurred by the Council (which for the avoidance of doubt shall include reasonable legal and other professional fees) in obtaining an independent professional assessment of the Affordable Housing Review submitted by the Owner to the Council pursuant to paragraph 1.1(a) above.
